Proposition 209
Prohibition Against Discrimination or Preferential Treatment By State and Other Public Entities.
Initiative Constitutional Amendment.
Summary: Prohibits the state, local governments, districts, public universities, colleges, and schools, and other government instrumentalities from discriminating against or giving preferential treatment to any individual or group in public employment, public education, or public contracting on the basis of race, sex, color, ethnicity, or national origin. Exempts reasonably necessary sex-based classifications and actions necessary for receipt of federal funds from prohibition. Mandates enforcement to the extent permitted by federal law. Requires uniform remedies for violations. Provides for severability of provisions if invalid.
Fiscal Impact: Could affect state and local programs that currently cost well in excess of $125 million annually. Actual savings would depend on various factors (such as future court decisions and implementation actions by government entities).
A YES vote on this measure means: The elimination of most affirmative action programs for women and minorities run by the state or local governments in the areas of public employment, contracting, and education that give "preferential treatment" on the basis of sex, race, color, ethnicity, or national origin.
A NO vote on this measure means: State and local government affirmative action programs would remain in effect to the extent they are permitted under the United States Constitution.
